CHARGE OF FAILURE TO GIVE INFORMATION (United Press Association) CHRISTCHURCH,. March 16. Judgment for the defendant ■ was given by Mr E. C. Lewey, S.M., in an action by the police against Jasper Lovell Nicolls, a salesman, of New Brighton. Nicolls, who was represented by Mr C. S. Thomas, was charged under the Traffic Regulations 1936 with failing to give information sought by the police. Legal argument was heard last month. The Magistrate, in his reserved judgment today, dismissed.the information, The Magistrate held that although the Motor-Vehicles Act left no doubt as to what must be done on demand by a traffic officer, there was a gap in the wording of the traffic regulations, under which Nicolls was charged, and that there was no onus, as in this case on the particular facts, to give information and so to be subject to a penalty for failing to do so.
