MAGISTRATE’S COURT
SITTING AT LUMSDEN (Before Mr R. C. Abernethy, S.M.) The following defendants were found guilty in the Lumsden Magistrate’s Court of being on licensed premises after hours:—John Holland, who was fined £llO/-, costs 12/-; Thomas Small, jun., who was fined £l, costs 12/-; Neil McPhee, who was fined £l, costs 12/-; Allan Murdoch, who was fined £l, costs 12/-; and Donald Brown, who was fined £l, costs 12/For allowing stock to wander on the roads N. A. Double and William Crooks each were fined £2, costs 12/- and P. O’Callaghan was fined £l, costs 10/For failing to keep to the left of the centre line on the road while driving a lorry, William Robins was fined £2, costs 12/-.
For driving an unlicensed motorcycle, W. F. Nicholson was fined 10/-, costs 10/-, and for not having a driver’s licence he was fined 10/-, costs 10/-. Judgment was given by default in the following cases: —John Marshall v. C. H. Humphries £l7 3/5, costs £1 5/-, solicitor’s fee £1 11/—; Goodall Brothers v. Allan McDonald, £34 2/3, costs £1 14/-; solicitor’s fee £2 16/-. John Macauley, of Athol, was ordered to pay £3O 5/6 and solicitor’s fee £1 H/fi,
immediately, in default 31 days’ imprisonment. John Leo Botting (Mr A. Smyth) was charged with fraudulently failing to account for moneys thereby committing theft. For the defendant Mr Smyth said that he had a debtor and creditor account with Charles McCreath. He had no intention of permanently depriving McCreath of the money and was therefore not guilty of the theft. In view of the debit and credit arrangement it could be assumed that the money was given to the defendant in settlement of an account. Tka casa was diamissed-
