DENTAL PRACTICE CASE
MOTION TO REVIEW INJUNCTION (United Press Association) WELLINGTON, October 13. Judgment was delivered by the Full Court in the case of Charles Francis Cooper v. Harold William Frost. A motion to review and rescind an order made by Mr Justice Reed granting an interim injunction against the defendant Frost was affirmed and enlarged as to its scope by the Full Court. On September 20 the Full Court considered a motion by the defendant, Harold William Frost, a dentist, of Auckland, to review and rescind an order granting an interim injunction made by Mr Justice Reed on July 23. The effect of the injunction was to restrain the defendant, his servants, or agents from using in or in connection with the defendant’s dentistry practice the name “Frost and Frost,” or any intimation to his patients or members of the public that the defendant’s dental practice was the same as or was a continuation of any dental practice formerly carried on under the name of “Frost and Frost” by the defendant, or by Frosts Ltd., or by the plaintiff, Charles Francis Cooper, dentist, of Wellington.
