QUEENSTOWN TO DUNEDIN.
APPEAL BOARD’S JUDGMENT. In the appeal of J. McLaughlin against the decision of the No. 9 Licensing Authority in refusing to renew a route license from Queenstown, via Cromwell, to Dunedin, the Appeal Board gave the following judgment:— The considerations involved in this appeal are very similar to those referred to in the decisions of Fox and Robins and Co. The board is. in the present appeal faced with a difficulty which has bln referred to by Mr R. D. Jamieson, of Ranfurly (counsel for the applicant). The decision of the local authority is largely based on representations made by delegates from local authorities. We can find no evidence on record of any such representations. It is true that there are recorded representations of this nature, in respect of this application in the vicinity, but we are not, we think, entitled to assume that this evidence forms part of the present proceedings on which, the appeal must be argued. We consider, therefore, the contention of Mr Jamiesson is well founded, and upon his record of the proceedings before the No. 9 Authority, we must find that the appellant is entitled to a renewal. It may be observed that the opening of the Queenstown-Kingston road may entirely alter the flow of traffic in portion of the appellant’s area license, and the considerations involved in his license may be completely altered when the matter comes under review next year. No order was made as to costs.
