STOLEN SILVER
FORFEITED TO CROWN. (Per United Press Association.) Auckland, October 11. The final steps were taken in the Supreme Court to determine the ownership of £BO7 in silver which was stolen from a motor car in Wanganui in June of last year. The money was claimed by the Crown in whose possession it was, on the ground that its owner was attempting to export it from the Dominion . and that it was therefore liable to seizure. The Solicitor General took proceedings by way of “information in rem” to claim the silver, the ownership of which was also claimed by William Toomey of Auckland. Mr Justice Ostler said that in his opinion the evidence clearly proved Toomey’s intention to export that silver contrary to the regulations. He was convinced that Toomey was engaged in an organized business to export silver for profit. The Crown had not only shown intention, but that overt acts had been done. Toomey’s, proved acts went far beyond preparation and amounted to attempt, There would be an order declaring forfeiture of the silver to the Crown.
