CASE SETTLED
COLLETT v. AGNEW GRIEVE LTD.
Following are the full terms of settlement in the above case in which the plaintiff (Mr T. Meredith) claimed £l3O damages against the defendants (Mr A. F. Hogg) while the defendants counter-claimed for £lO4 3/7: Plaintiff withdraws claim and defendant withdraws counter-claim.
Defendant pays plaintiff £36 which shall be taken in full satisfaction of plaintiff’s claim for profits on re-sale of the car. Neither party to have tiny claim or bring any further action in respect of the car or of the repairs or goods supplied. Each party pays own costs.
Plaintiff’s counsel to make the following statement in open court for publication: “That after investigation of the speedometer by experts the plaintiff’s solicitors are satisfied that it had been damaged and was not registering correctly and that the mileage had in no way been falsified by the defendant company. The plaintiff unreservedly withdraws all allegations of misrepresentation as to the condition of the car or as to the mileage it had done made against the defendant company. The car has been resold at a profit and plaintiff has been paid £36 in full satisfaction of any claim he may have to participate in the profits of such resale.”
