IMMUNE FROM PRODUCTION. WANGANUI, November 8. The question of whether a police constable’s official report concerning an accident should be used as evidence in a subsequent civil case was discussed in Court to-day during the hearing of a claim for d am ages, It was objected for the police that an important principle was involved. The Police Department held that its reports were privileged from production in cases, and that secondary evidence of their contents could not be given. If the confidence of parties to an accident given to a constable who was making official inquiries was allowed to be given in evidence in civil actions, it would dry up the sources of information. A Supreme Court authority was quoted supporting this attitude. The Magistrate held that the police objection was a proper one. He stated, however, that there did not appear to be any objection to the constable producing a plan of the marks which came under his personal observation.
