SEQUEL TO AN ASSAULT
COUNTY COUNCILLORS IN COURT. At the Supreme Court, Hamilton, Edward Joseph Darby claimed £2OO damages from Charles Stopford for alleged assault. Both parties are members of the Matamata County Council. After a heated debate at a meeting, the parties met at a hotel, when Darby said to Stopford: “Put out your hand to show that there is no ill feeling.” Stopford, however, struck him, knocking out a tooth and splitting his lip. Defendant said that he only pushed Darby and did not strike him. He apologised at the next meeting but Darby refused to accept the apology. His Honour said that the evidence showed plaintiff was a bumptious, aggravating and tactless person and was to blame for the whole incident. Yet defendant was not justified in striking him. He awarded Darby £1 damages on the claim and £6 special damages, costs being allowed as in the Magistrate's Court.
