A MINING CASE

MAN NOT WITHDRAWN FROM UNSAFE PLACE. (Per United Press Association). DUNEDIN, December 3. At the Police Court David McNeil waa charged with failing to withdraw Robert William Smith from an unsafe place in the Brighton coal mine. Mr Macgregor, K.C., who prosecuted, said that the defendant was manager of the mine aud Smith was killed by a fall of stuff. The defendant at 7.55 a.m. on the day of the accident examined the face where Smith was working and found it safe. At 2 p.m. he again visited the place and heard a sound which indicated looseness. The defendant told the deceased to take down the stuff and on returning at 3.5 p.m. found this not done and told him emphatically to take it down. The fall look place almost immediately afterwards and Smith was killed. Defendant’s counsel argued that the instructions given were reasonable. The Magistrate said that defendant should have withdrawn Smith. The defendant was fined £5 and costs.
