RAILWAY APPEAL BOARD
DEADLOCK AT PALMERSTON. TECHNICALITY MUST BE OVERCOME. (Per United Press Association). . PALMERSTON NORTH. March 25. The Railway Appeal Board commenced its sitting here this afternoon. ' Mr Hasclden presided. Mr C. P. Ryan representing the first division and Mr IX X>ywer the second division. Mr Davidson appeared for the Department. When the first appeal was called, in Which Walsh, a clerk on Lambton Station. Wellington (represented by Mr Hanlon! appealed against the withholding of a recommendation for bis pro- j motion to the next sub-grade, an argu- ; ment ensued as to whether Mr Duncan I (Traffic Manager! was allowed to sit j alongside Mr Davidson and coach him. i seeing that he was to give evidence against the appellant. Later the Magis- j trato ruled that he had u right to be | there. Mr Ryan objected and quoted subsection 3 of section 62 of the Act to show tliat the Department’s case had to be conducted by some member appointed by the Minister on behalf of the Department. Mr Dwyer and Mr Ryan left the bench to* confer as a deadlock had been readied, and after an hour’s adjournment no mutual arrangement had been arrived at. The Court was therefore adjourned till next morning. The Magistrate stated that there was a rock in the way and pointed out that it would kitve to be settled once and for all.
