The petitioner was Thomas Morgan’, manager of the Vinegar Hill Co., whose mine was previously owned by Ewing and the ground was that judgment; had been returned nulla bona. For t;hn del-tor it was contended that the proieedings were taken because, if Ewing was made bankrupt, the. petitionermight be able to secure some things cheap ; because the Vinegar Hill Co. wanted to get the use of Ewing’s tail race, which he had stopped tl’.enl from using, or because L-U’.ki'uptcy would stifle Ewing’s appeal asninst the Scandinavian Co., directors of which iwere also directors of the Vinegar Hill Co. Decision la the matter was reserved.
