Monday, 3rd Nov. Before Mr S. E. McCarthy, S.M. after a collision. John Stevenson v. James Smith was a claim of £4612s for damage to horse and trap in a collision on North Road on 11th October.—Mr J. Macalister for plaintiff; Mr Moffett for defendant.—H. S. S. Kyle, veterinary surgeon, gave evidence that be examined the mare the same evening, and found it considerably cut about. The near fore leg would bo always blemished, as the injury was ” broken knee,” but the other cuts would heal up. The injuries would not physically affect the mare ultimately, but would be an eyesore, and affect her value in the market. Before the accident would have valued the mare at £3O, but could put no definite price on it now.—J. Jopp gave evidence that the mare was a good’ useful sort. Valued her at £3O before the accident ; he would not have her at all now for the class of work he would require, though she might be good enough for otherkindsof work. — J McGregor gave evidence that he had exicutcd repairs lo complainant's trap, costing £6 12s.—P. Williams gave evident that he saw the collision. The ilcfemlmt took the reins from Miss Smith (mil drew over in front of Stevenson’s irap -Ihe plaintiff said that defendant was ilt.vjngin front of him on the North Road. There was plenty of room for witness to pass, and he was only going at a jogging pace when ho tried to do so. The defendant seemed to scramble for the reins from his daughter and pulled his trap right in front of witness’, and upset it.. There was no other vehicle within seven chains at lea-t at the time. Had been offered £3O for the mare before the accident. The hearing was adjourned till 10 a.m next day.
