New Zealand (Per Press Association.) AUCKLAND, April 24. Bernard Kane, a settler, was found dead on the road near Matakohe near his capsized dray. Arthur Wood, a Whangarei settler, recently deceased, has bequeathed ti the Auckland asylum and hospital the balance of his estate after payment of certain legacies. Board today by counsel, who made a claim on the eState ‘ WELLINGTON, April 24. A new trial is to be moved for in the case Trotnmer v. the U.S.S. Company on the grounds that the verdict was against the weight of evidence ; that the judge misdirected the jury of the misconduct of one of the witnesses and certain jurots in conversing about the trial; that plaintiff was taken by surprise by the evidence of Detective Nixon. The ground upon which a new trial will be asked for before a judge alone was that owing to the influence and power of the company at Wellington it was impossible to obtain a fair trial before a class jury drawn from the special jury class. A charge of alleged assault preferi ed by Mrs Higgins against Detective Broberg for ordering her to leave the course at the trotting races on the ground that she was a bookmaker, was gone into this morning. After it had been partly heard, complainant withdrew the information, counsel intimating that civil action would be taken. Three charges have beon laid against Alfred Crossey, a well-known publican, under the Bankruptcy Aot, of failing to keep proper books, improper payments, reckless speculation, and gambling. A young woman named Catherine Butler has been killed at Bald Hill Flat. She was driving with her sisters when some dogs rushed at the horse causing it to swerve off tho road. Tho animal thou commonood kicking and struck Mies Butler while sitting in the trap, killing her. Her two sisters escaped injury. At the inquest on the child Gallagher a verdict of accidental drowning was returned, the jury adding a rider that the Corporation should close up holes in the street at the side of the wharf.
