Extract from the Riverine Herald, N.S.W,, 10th October, ISC!. ECHUCA POLICE COURT, Tuesday, October 9th, 1894. j (Before Messrs Dwyer, P.M’, and P. Nolan, J.P.) 1 Michael Roache proceeded against for FALSELY APPLYING THE TRADE MARK of the STIRLING BONDING CO., LD. Mr Campbell appeared for the defence and pleaded not guilty, and asked that the defendant bo dealt with summarily. Michael Roach deponed that he was an inspeclor of licensed houses, and produced his authority to prosecute. On the 24th August witness called at the hotel. Took up a bottle of GAELIC WHISKY. Tested it and found it to contain common whisky diluted with water. It was 30 degrees under proof. Defendant said he sold it as he bought it. The whisky was exposed for sale on the shelves with other liquor. To Mr Campbell : Examined all the liquors on the premises and f und them correct with the one exception. There had been a fair run on the Gaelic whisky at onetime. Knew that in order to meet the demand for a certain liquor it often dot, rioialed. John Peter Smi’h, an expert in liquors, depone,! that he examined the bottle produced and found it to be 30 8 under p oof. IT AS NOT GAELIC WHISKY HUT A COMMON ARTICLE diluted with water. Genuine Gaelic whisky is about 17 degrees under proof, AND IS ABOUT THE BEST WHISKY IMPORTED. THE WHISKY TAKEN FROM DEFENDANT WAS NOT WORTH MORE THAN HALF THAT OF THE GENUINE. The licensee of the hotel deponed that the instructions he had given in his hotel were that no water was to be put in any liquor, and the btt'k whisky was to be put in a decanter. If he had had any suspicion that the liquor was inferior ho could have remr-Ved the bottle, as he knew the excise ofliccr was in the town. He had not put any water in the whisky in question. A Wife of last witness deponed that she frequently attended to the bar. The bottle of whisky in question was open about eight or ten days. Had never put any water into the bottle. Had put draught whisky into a decanter. g A daughter of the defendant gave similar evidence. Defendant (re-called) said he purchased the bottle bearing a similar brand at the hotel. Mr Campbell here asked for the expert to test the liquor seized and the bottle bought, and Mr Smith replied that there was uo comparison.
