John Lee Aston (Invercargill), for L 5 ss, costs 8s ; Herbert, Haynes and Co v. G. Ross, for Ils sd, costs ss; Robert Smith v. Donald Manson (Wreys Bush), for L2O 9s, costs L2 14s. JUDGMENT SUMMONS CASE. J. H. Whitaker v. William Birchall— Claim L 8 14s Id on a judgment summons.— Mr Henderson for the defendant, who was examined on oath and pleaded inability to pay through lack of remunerative employment.—The plaintiff gave evidence as to the manner in which the debt was contracted by the defendant’s wife, but his Worship decided that as there was no evidence that the defendant had been able to pay since the date of the judgment no order could be made. defended case. James Adamson v. John Mclntyre (Grove Bush).—Claim, L 8 for damages alleged to have been caused by a dog belonging to defendant worrying plaintiffs sheep. —Mr Macalister for plaintiff, Mr Russell lor defendant.—The dispute between the parties was as to whether or not the sheep had been worried by the defendant’s dog, a number of other similar dogs (greyhounds) being about the neighbourhood, it being also contended for the defendant that even if it hud been his dog the amount claimed as damages was unreasonable and excessive.—After evidence had been partly taken, the further hearing of the case was adjourned for a week.
