Dawson v. Regina.
+ . [By Telegraph j Wellington, Nov. 18. The case of Dawsoa v. the Queen, which was commenced in the Court of Appeal on Fiiday, was concluded this afternoon. The appeal was against the decision of Mr Justice Williams in granting a new trial. The appellant waa owner of a sawmili burned down, and at Invercargiil, in March last, an action was brought by him against the Queen for the value of the property destroyed, as it was alleged that a spark from a railway engine had set fite to the mill. The jury returned a verdict for L 1650. A new trial waa subsequently "granted by Judge Williams on the ground that Dawson had not proved that the railway officials had been guilty of any negligence, and it was against this order that Dawson now appealed. Their honors sustained the appeal, holding that a new trial was not required.
