The Sarah W. Hunt.
* [By Telegraph.] Christchurch, Feb. 20. The case of Wm. Hartrig aga'nst the captain and owners of the American schooner Sarah W. Hunt was brought on at the Lyttelton R.M. Court this morning. Mr Fisher for plaintiff ; Messrs Nalder and Martin for defendants Cunder protest) ; Mr George Harper for the American Conj sui. Mr Harper raised the objection that the Consul had full power to deal with the matter. The Bench declined to accede to this until the case was entered upon. Mr Nalder made objection as to the service of the summons on the ship instead of personally.. This was over-ruled. He then submitted that the defendants should have been expressly named. The Bench allowed amendment of the plaint by the insertion of the name of Sanford Stephen, miner. Mr Nalder then submitted that the owners were outside the Court's jurisdiction. This objection was held fatal, and the plaintiff was nonsuited with costs. The other case against the same defendants was withdrawn, Mr Harper stated that since the American Consul was informed of the castaways' circumstances they had been maintained by United States funds, and the Consul was prepared to ship the men to their own country by the 'Jfliaco paail boat,
