RESIDENT MAGISTRATE'S COURT.
(Before H. M'Oulloch, Esq., "R.M.) Friday, Janttaet 15. 2%e Inspector of Nuisances v. Henri/ Mayo.— Mr Macdonald for the plaintiff. The defendant was charged, under sections 33 and 40 of the Public Health Act, with keeping a pigsty near a dwelling-house. He pleaded guilty ; but said he had for some time been endeavoring to get a pigsty erected at Waikiwj, but could not proceed with it on account of the scarcity of carpenters. Mr Macdonald said that he was constrained to ask for a substantial penalty, as t c defendant had received three separate notices to do awaj with the nuisance ; but he had only made pro~ mises, which he had not carried into effect. The nuisance was not an ordinary pigsty, but. an extensive yard containing a great quantity of reeking manure and a largo number of swine. The defendant was the only person in town who had a pigety near a dwelling. Tlio "defendant — I will remove it as soon as possible, to-morrow, if I can. The Court — You ought to have remoTed it immediately on receiving the first notice to do so, whatever the expense. The Legislature had imposed it as a duty upon tho local Board of Health to do away with such detestable and dangerous nuisances, and it was right and necessary, in such cases, to carry the law rigorously into effect. Fined £5, with cost.', £2, ss. Police V. Teviotdale.—Glmrve of allowing a foul chimney to take fire. Adjourned for one week. SATITfiDAY, jANUATHf 16. Mary Leonards was fined 53, or 24 hours' imprisonment, for being drunk and disorderly in Esk street. John Duncan was charged with drunken and disorderly conduct in Dee street, and was fined ss, with the usual alternative. The fine was paid. >___«__«__-_
