James Cook, recently a storekeeper at Woodlands, was charged wi'h obtaining goods on falsa pretences from Messrs Mathosou and Smith in March aud April last. Mr Wade appr-aro i for the prosecution, and Mr Harvey for the defence. The evidence was simiiar to that which was given at the preliminary examination before the Resident Magistrate, and published in our columns at the time, bein^ mainly to the efil'ct that Cook had obtained certain good* from Messrs Matheson and Smith in consequence of a repteaentatitn that £300 would cover all his liabilities, whiiraaa he filed a statement in th« Bankruptcy Court within a day or two of making such statement, showing liabilities to the extent of £1800, and proof was led to show that when Cook made the statement he must have known that it was false. The case broke down, however, from the prosecution failing to prove the actual delivery of the goods in question, and His Honor having directei the jury that in the absence of such proof there was no case for them to consider, a verict of " Not Ghiilty" was returned. His Honor remarked that the evidence which had been adduced for the prosecution would bo of very considerable value before the Bankruptcy Court.
