Surfidge with stealings groper valued at ss. He admitted taking the fish, but stated that it was the result of a lark, , His Worship severely , cautioned the accused, and-pointed- out. thatj-he had laid himself open to a conviction as a thief. Under the circumstances, and with the consent; of the informant, he would, the' information, defendant to make restitution. ' He would haye to pay. 5s for the fish, conrt costs and costs of one subpoenaed witness 3s 6d. J. Sim v. J. H. Brosnahan, claim 4s, balance of a debt of 11s. There'was no appearance of the defendant. His Worship accepting plaintiff’s version that the defendant had obtained a receipt -by ; , false, representation, ■ gave judgment for the amount claimed and costs. At a later hour, defendant; appeared, apologised for delay and applied - for a rehearing of the case, claiming that he had paid in full. The application was granted. E. McCullough v. E.‘ Mitchell. Evidence in this , taken for transmission to Dunedin, and, the court adjourned.
