(By Telegraph.) Captain Russell’s “ Hack ” NAPIER, July 8. In the case Napier Park Racing Club v. Captain Russell, a claim to recover the stake won by Van Diemen, j udgment was for plaintiff with costs. After the stake was paid over it was discovered the horse was ineligible to start. The club then paid the stake a second time, to the second horse, Captain Russel refusing to refund, believing his horse was eligible.
