GBEALDlNß—Wedsesdat, June 11th. (Before 0. A. Wray, Esq., R.M.) CIVIL CASES. ,B. 11. Postlethwaite v. J. M. Shepherd. Mr Hay for plaintiff. Judgment by default. Wreathe!! B.ros. v. T. IT, Wigley—Claim £SB 10s, for pigs alleged to have been destroyed by defendant. A set off had been filed for £KO by defendant, for damages alleged to have been sustained through plaintiff’s pigs trespassing on his land. The evidence of witnesses for plaintiff occupied the Court till the adjournment, and on the Court resuming, it was staled by Mr Hay that both parties had since the rising of the court, settled both cases, defendant agreeing to pay £3B 10s, together with witnesos’ costs amounting to £3 ss, solicitor’s fee £2 2s, and court costs £3 13s. . .(Before the Resident Magistrate, Mr H. W. Moore and Hon. T. H. Wigley), Michael Connolly sued John Albert for £2 13s, being balance of amount stated to bo duo for set of harness. Mr E- Wilson Smith for plaintiff, and Mr Hay for defendant. The latter had filed a sot off for 119 hours overtime. The plaintiff deposed that during the lime defendant worked for him he purchased a -set of harness from him, but had not paid for it. Ultimately plaintiff had to deduct it out of his wages. When they squared their accounts between them defendant owed him £2 13s. On his summonting defendant the the latter sent him an account for overtime work which ho had never agreed to. Defendant deposed to his getting over time, and plaintiff had paid him certain amounts for overtime work till tho end of July last. .. As there evidently was a misunderstanding between them in regard to overtime and value of tho harness the defendant called Henry Parker, who gave evidence as to the value of the latter, and Albert Wilke stated he Lad worked in the shop with defendant at a lime when ho was working till 9 and 10 o’clock. ‘ ■ , . The Bench after nearing considerable evidence gave judgment for £1 3s, and did not consider that it had been shown that payment was to have been given for overtime. Mr F.
