TIMAEU-YESTERDAY. (Before His Honor Judge Ward.) CIVIL CASES. John Pearson v. O. Bourn and others —Claim £22 Os fid. Mr White for plaintiff, Mr Tosswill for defendants. This case was concluded last night, His Honor deducting a sum of £lO for defects in the dip and £3 on account of deficiency in the draining stage, and giving jupgment for the balance, each side to pay its own costs.

THIS SAT, IN BANKRUPTCY. Be A. Adams, a debtor. Mr Knubloy, on behalf of the Deputy Assignee, applied for an order against P. Childs to give up a cart obtained by him from the bankrupt Adams. Mr Perry opposed the application. Affidavits were produced showing that the bankrupt’s wife sent the cart to Childs during her husband’s absence, under threat that be would take it if she did not promise to send it, the bankrupt knowing nothing obout it till afterwardsAn order for the return of the cart wa» asked for on the ground that (1) tho taking of the cart was a wrongful eon' version of it by Childs, and (2) that the giving of it by the wife was a fraudulent preference. His Honor ruled that the second ground was contradicted by the bankrupt’s affidavit, that he knew nothing about it, and as to the first ground, the matter should be tried in the ordinary Court. The order was accordingly dismissed with costs.
