THE PHARAZYN DOUBLE-VOTING CASE.

FBt Telegraph.]

Wellington, Jan. 5

At the Supreme Court this morning the charge of personation preferred against the Hon J. Pharazyn was heard. Defendant alleged that his second voting was through his mind being much occupied and quite unintentional. Thu Judge summed up briefly, and after referring to the evidence gave it as his opinion that the offence had been committed. He directed the jury as to finding a verdict. After a few minutes deliberation the jury returned with the following .verdict: —“ We find that Mr Pharazyn having voted at the election for Thorndon did apply for a second voting paper in the 'same electorate, but that the application was made under the the impression that he was voting in a different electorate and for another candidate.” The prisoner contended that this was a verdict of not guilty. The Judge, however, held that it was a verdict of guilty, and reserved the question for the Court of Appeal, prisoner being bound over in his own recognisance of £SO to appear for judgment when called.
