The Supreme Court rejected the petition of Mr. Albert Levitt, formerly the assistant Attorney-General, who sought permission to file a suit for the purpose of unseating the newlyappointed judge, Mr. Justice Black, from the Supreme Court Bench on the grounds of a legal technicality.

The court also rejected the request made by a Boston attorney, Mr. Kelly, for a commission to investigate Mr. Justice Black's eligibility.
