SUSTENANCE FRAUDS
GAOL SUGGESTED DOUBTS OF MAGISTRATE (Par Press Association.') AUCKLAND, last night. Doubt as to the authority of the court to impose terms of imprisonment as penalties in cases of unemployed men obtaining moneys from State funds by means of false declarations, was expressed in the Magistrate's Court at Otahuhu by Mr. W. 'R. McKean, S.M.
"I am not going to impose penalties by means of imprisonment," said the magistrate. "It may be argued that these are offences under a special Act, for which the Legislature has declared that persons responsible shall be liable to fines. lam not saying that it is wrong to take action in the court under the Justices of the Peace Act, but it may be possible for someone to apply for habeas corpus, and the Supreme Court may hold that the penalty through imprisonment by this court was wrong, and this court is not going to do that."
