ALLEGATION OF FRAUD

Fraudulent misrepresentations concerning the sale of an unnamed three-year-old gelding, said to be by Captain Bunsby out of Lubrication, were alleged in the' Supreme Court to-day when the recession of an agreement of sale and the return of the purchase price was sought. The plaintiff is Walter Smart, of Wellington, pawnbroker, and the defendant is Arthur Edmond Preston, jun., of Wellington, butcher. It is contended that, far from being a racehorse, the horse could not even gallop because of a hip disorder. The purchase price, it was set out in the claim, was £2OO cash and another horse named Maritime. It was bought, the plaintiff alleged, on representations that it was sound and could hold its own with Mittio over four furlongs. The plaintiff alleges that the representations were known by the defendant to be false. The return of the £2OO and the horse Maritime is sought.
