JURY’S £770 AWARD
CLAIM FOR DAMAGES MOTOR SMASH SEQUEL (Per Press Association.) AUCKLAND, last night. The hearing of a claim for .1.2000 damages, under the Deaths by Accident Compensations Act, was concluded in the Supreme-Court to-day before Mr. Justice JCallan and a jury. The action was brought by Arthur Burrows, of Matakohe, farmer, as administrator of th* estate of his wife, Isabella Burrows, and the defendant was Esmond Henry Savage, of Tahuna. sawmiller.
The action arose out of a collision between a truck and motor-car at t.lic corner of East Taniaki road and Great South road, at Papatoetoe, on April 27, 1936, and Mrs. Barrows died two days later. The car in which she was a passenger, was driven by Oscar Clausen, her husband’s brother-in-law, and the truck was owned by the defendant, and driven by his employee, Rangi Weke. The plaintiff alleged that the accident was due to The negligent driving of Woke. The defence denied any negligence. The jury returned witli a verdict for the plaintiff for £750 damages and funeral expenses of £22. The damages were apportioned by the jury as follows: £4OO for the plaintiff, £IOO for his elder daughter, and £250 for his younger daughter.
