An action arising out of the Joss of the pacing gelding, Silver Bingen, which, it was alleged, had to be destroyed after it had been gored by a dangerous bull belonging 'to the defendant, wns heard in the Magistrate’s Court, when the owner of the horse, Mrs. I. E. Sweetapple, claimed £152 damages, including £2 2s veterinary surgeon’s fee, from Hugh Hedley, a farmer, of Auckland. In the statement of claim, the plaintiff said that Silver Bingen had been delivered' to the defendant on April 12, and in return for earing for the horse lie was to receive 5s a week. It was alleged that, owing to the defendant’s negligence, the horse was attacked oy a bull in the same padclock, with the result that the horse had to be destroyed on May 22. The defence was ifjiat there hud been no contract between the plaintiff and the defendant, and that the defendant was not guilty of negligence. . The case was adjourned.
