SOLICITOR EXPLAINS

NON-APPEARANCE IN CASE (Per Press Association.) WELLINGTON, this day. Before another case in which he was engaged was called in the Supreme Court yesterday, Mr. H. F. O’Leary made a personal explanation of his non-appearanee for the defendant in tho Holliugs case the previous day. Mr. O'Leary said he lyid on Friday informed Rollings, quite delinitely, that as he was engaged in the preparation of material in another action he could not appear for him, and he must get some othor counsel. He assumed that he was out of the matter, and ho asked the court to accept his assurance that not for a moment had ho the slightest thought of discourtesy, or want of duty. Mr. Justice MacGregor said he accepted Mr. O’Leary's explanation.
