WELLINGTON, this day. .That the price,of the.car concerned in the dispute had been infiated and over-insured by a fraudulent device of the plaintiff, company, acting throiigh the managing, director and the (Napier agent, p;as the conclusion reached by Mr, J.ps.tice MacGregor in a reserved judgment,, ill the e,asp in, which the Tourist Motor,Company, Limited,, Hastings, claimed £llOO against the United Insurance Company, Limited, on a policy over a nino-seater car sold thy the'plaintiff to Leonard Ralston Wyllie in February, 1931, on behalf of a brother, under a hire-purchase agreement for, £ISOO. His Hpn.or was satisfied that the cash value of the ear,.when sold, was not £ISOO, but,, to the knowledge oj. Hislop, not, more than £1250. The car was used as.,a service car, hut the run was not a -success,:.and the promissory notes .field hv the plaintiff fell into arrears,, and the car was . taken hack to the plaintiff’s garage, at Hastings, where it was. destroyed by fire in October last-year.- —-
