ORMOND ASSAULT CHARGE
ACCUSED’S CONDITION MEDICAL EVIDENCE SOUGHT A plea that the accused in an assault charge was not in a tit condition to appear in court was made to Mr P. If. 'Harper, S.M., to-day, when Julius Hansen was charged with assaulting Francis John Warrington by striking him on the face with his clenched fist. At the outset, Air J, Kinder, appearing for the accused, asked for an adjournment for six weeks in order to enable the accused to go into hospital for treatment. Senior-Sergeant Wade objected, and said that if the man -was well enough to come into town to see the doctor, he was able to attend court. All the witnesses wore 'brought to the court for the hearing on n previous occasion, and they were present again to-day. The accused had told the > Seniorsergeant that he was suffering from nerves. A doctor said that it would do the accused good to come to the court and get tho matter over. His Worship said that the case was called a Week ago and was adjourned to enable tho accused to go into hospital. lie had not done so, and His Worship saw no reason why the case should not proceed. 'The case was stood down until later in the morning, when Mr J. tie W. 'Blnthwayt, who appeared for tho accused at this stage, said that tho accused was not in a lit state to plead. Counsel had not been able to secure medical evidence so far, for the man in his present, state of health was very difficult to deal with. His Worship said lie did not wish to proceed with the case if the accused was not ip a fit state, but lie should be examined by a doctor. The case was adjourned until 2.30 p.m.
