COURT OF APPEAL
SEVERAL DECISIONS GIVEN
(Per Press Association.) WELLINGTON, this day. The Court of Appeal to-day delivered judgment in several cases heard earlier in the month. In the appeal of Mrs. Eva Dwan in a case in which judgment had been given against her in. favor of Dr. Findlater and Henry Bingham, arising from from an accident on the Hutt road, the appeal was dismissed but tho judgment in Dr. Findlater’s case was varied by reducing the amount of tho damages. The assessment of the Commissioner of Taxes against William Robert Komball iu respect to sums paid for talkie apparatus was confirmed by the court. In the case in which -fames Gray Wright, a laborer; appealed against- the decision given in favor of the Cunningham Carrying (>., Ike appeal was allowed. The jury which tried tho case had awarded Wright £453 damages for injuries sustained through being struck by a lorry owned by the defondaTits, but judgment had been given for the company on the ground that negligence, had not been proved against the lorry driver.
