WORKERS' COMPENSATION

DEFECT IN THE LAW AE AMENDMENT PROPOSED (Parliamentary Reporter.) WELLINGTON, this day. With the object of remedying a deficiency in New Zealand law relating to compensation in respect to death from accident, the Hon. W. Downie Stewart (Ref., Dunedin West) gave notice in the jiouse yesterday of the introduction of the. Death by Accidents Compensation Amendment Bill.

He hopes the Government will afford facilities for consideration of this session as it seeks to deal with an important aspect of the law. There was a recent case in Dunedin in which it was discovered that relatives of a deceased man claiming compensation in respect of an accident due to the negligence of some peison were prejudiced in the assessment of damages because the court was bound tinder New Zealand law to take into account insurance and other.benefits to which the deceased was entitled. Thus it is possible for any wrongdoer who causes the death of an individual to benefit from the victim's thrift. This position was remedied some years ago in the English law, and it is the object, of Mr. Stewart's bill to bring New Zealand legislation into line with the more equitable position obtaining elsewhere.
