FULL COURT TO DECIDE SYDNEY, July 2(5. A notice of appeal was lodged this afternoon to the Full Court of New South Wales by Messrs. A. S. Boulton and Co., solicitors, 11)4 Hunter street, Sydney, against the decision of Mr. Justice Halso Rogers on Juno 20 last in dismissing an application in which it was alleged that the judge (Mr. Justice Campbell) at the date of delivering judgment in the case of the Celebrity Pictures, Ply., Ltd. v. Wilfred Turnbull, was over -the statutory age of 70 and, consequently, functus officio. The affidavit, by Air. Holmes, of A. S. Boulton and Co., in support of the appeal dealt, with certain evidence relative to the alleged proof of flic judge’s ago, discovered since the dismissal of the application. The evidence, the affidavit further stated, dealt with certain communications from Scotland, and certain statements on Mr. Justice Campbell’s marriage certificate.
