lit the alleged cattle sick land case in Hamilton to-day, the evidence for the defence' was ail to the effect that Pinney was informed of the nature of the sick ness before he purchased the land, and that the remedy was indicated. One witness stated that the . sickness was caused through infection of (lie stomach through eating rank feed, which was not uncommon in other parts of New Zealand. At Bunnytliorpo in one season 80 to 100 cattle died from this cause because new settlers did not realise the necessity of. top dressing and keeping feed down. (Proceeding.) •The Magistrate, Air. McKcan, gave judgment in Auckland this morning in the action .brought by Nurse Blanche Donald, of Auckland, for nursing fees, £0 I.ls, against. •Thomas Clarke, a millhand, of Mamaku, in respect of .the birth of Mrs. Clarke's baby., which died the day after birth. Clarke counterclaimed for £O." 12s Sd damages, alleging negligence. In a lengthy written "judgment His Worship concluded: "I am of the opinion that a broach of duty was established, but the evidence docs not establish that Mrs.' Clarke's condition is the direct or proximate result of that breach. The husband, therefore, is entitled only to nominal damages, £.l, with court costs and witnesses' expenses. The sjiglit annoyances of which Mrs. Clarke complains are insufficient to disentitle plaintiff to bo paid, except a deduction for the first day, and judgment .therefore given for Nurse' Donald for £9 on the claim.""
