N.S.W. NEWSPAPER TAX AN INJUNCTION SOUGHT SYDNEY, Dee. 31. In order to test the validity of the recently-passed Newspaper Tax Act, a writ has been issued out of the High Court on behalf of the Sydney Morning Herald, Daily Telegraph, Sun and Evening News, claiming a declaration that the Act is invalid, being inconsistent with the" provisions of the Commonwealth Constitution. Plaintiffs ask for an injunction restraining the State of New South Wales and the Colonial Treasurer from proceeding to enforce the Act. They will on Tuesday next, the first day on which the court opens, file a notice of motion asking for an interim injunction in accordance with the claims in the writ. The four newspapers have engaged leading counsel to appear in the case.
