(Per Press Association.) AUCKLAND, last night. In the Wnirakei ease yesterday, Mr •f. (!. Rente!!, secretary, was cross -
examined at length as i o .Mr Cleave's connection with the company. Mr Myers, opening lor the defence, raid the company's case depended mainly oil legal considerations. The claim in the first, cause of action was entirely inequitable and the company could succeed only on purely technical grounds. The work had been done, and morally and equitably Mr (.‘leave was entitled to payment. The Second and' third causes of action were merely alternatives to the first. With regard to the claim for £72"0 if t.he company succeeded, it would have enriched itself to the extent of £1259 at the expense of Mr Cleave. If there were any cause for action it was for the transferees who slmuid bring claims.
Evidence? was given by Judge l!ee who, before his elevation to the l’cnel was one of the original directors of Wa rakei, Ltd.
