JUDGMENT RESERVED. (Per press Asairiatinii.i WELLINGTON, last night. The Court of Appeal concluded this afternoon the hearing of argument in tho case of the Gisborne Harbor Board v Lysnar. .Mr. Hanna addressed the Court- in support of Mr. Treadwell’s argument for Lvsnur. He contended that the plan which tho Harbor Board proposed to use had int Lvjii the result of independent won; un tin; part of Reynolds. Reynolds an 1 Lysnar had no common sources of information, but Reynolds had copied Lvsnar s plan in its main ideas. Mr. Myers, in his reply, said that ilieie con hi not be copyright in an idea, but that if there could be such copyright then it was Lysnar who had committed the infringement, in that lie had made use of an earlier idea in a plan prepared in 1892. In any case, lie said, if Lysnar had any remedy it was a remedy against Reynolds, not against the Harbor Board. If there was any breach of confidence it was on Reynolds’ part. Mi. Treadwell continued argument yesterday in support of Mr. Justice Reid’s judgment. Mr. Hanna also addressed the Court on the point that the cvYn-uce did not show that in this case there was independent labor bestowed by Reynolds, but that all he did in the wav of preparing work was to tost the feasibility of Lysnar’s idea: Mr. Myers replied' to all points raised and/' concisely repeated liis arguments against Mr. Justice Reid’s judgment.
