INTERESTING RACING APPEAL. REMOVAL OF DISQUALIFICATION OF TAMAAROA. (Per Press Association.) Wellington; tins day. In the matter of the appeal by P. A. Swney, owner of the horse Tainaaroa, against the disqualification of the horse Tamaaroa under part XXIV', rule 4, of the .rules of racing, consequent upon the disqualification of S. Les Boles, the previous owner, by tlio Auckland district committee, the judgment of the New' Zealand Racing Club judges, C. PSkerrett, 0. S. Watkins, and Wm. E. Bidwell, is as follows: "This is a case in which P. A. Swney states that ho purchased the horso Tamaaroa from S. Les Boles in perfectly good faith, and without any knowledge whatever that a breach of the rules of racing had been committed by tho said S. Les Boles prior to tho date of the sale of the said horse Tamaaroa. S. Les Boles, previous owner of the horso Tamaaroa was some months after the sale of the horse by him to P. A. Swney disqualified by the Auckland district committee for a term of three years from < 15th March, 1923, for corrupt practices committed by him on or about 11th and 12th' March," 1921. Under part XXXII, rule 4. of the rules of racing, it isi provided that no horse of which a disqualified person is, or of which he was at the time the 'offence was* tlio owner, shall bo qualified to be entered or to start for any race- Provision is also made whereby any person owning or having any intrust in a horse which by reason of this rule has become subject to tho disabilities therein specified may appeal to the conference, and the judges appointed to hear the appeal may confirm or remove the disabilities in whole or in partj or grant such other relief to appellant, or make such order in the premises us to them may seem meet. We are satisfied that P. A. Swney purchased the horse Tamaaroa in good faith from S. Lew Boles, and wo order tho removal of the disqualification of tho said horse Tamaaroa as from the date of the purchase by P. A. Swney from S. Les Boles, viz., 3rd April. 1923. We direct the deposit to bo refunded to appellant." Messrs. C. P. Skerrett, O. S. Watkins, and Wm. E. Bidwell, who had been appointed by the president of the Racing Conference to adjudicate upon the appeal of Leslie Boles against the decision of the Auckland District Committee in disqualifying him for a term of threo years, from March .l.">, 192;!, for corrupt practices under the rules of racing, find that the evidence was sufficient to justify the district committee in coming to the decision at which they arrived. They have, therefore, affirmed the decision and dismissed the appeal, with £2O costs against the appellant. 'Per Press Assoclntion ' PALMERSTON N., this day.
