He Had hot denied, her statement to that • effect. Accordinjcf to. the evidence, he was anxiou_ that Eyre should be put out of the wiiy, evident'y having an attachment for Mrs. Eyre. After reviewing other points in the case, his Honor read certain evidence of alleged statcmehts by.' Thorn- which tlie iudge. said 'implied that' Thorn was present and saw the murder, or -that he knew who committerl the mjjrdjer, yet he did not choose to give an explanat'or^ of why he made those statements.
