Tlie defence contended that, if plaintiff was not- .satisfied with the accommodation he was given, he shouln have gone to .the proper authorities. Had lie done tliis he would have been given his choice of six deck cabins, ire was* given a saloon berth, although it was what was known as an -'omnibus cabin.'* The claim was laid under sec-' tion mof tho Shipping and Seamen Act, but as it was not lodged witnin me specified time, plaintiff was oui. of Court Plaintiff was non-suited on the ground that the claim had been made beyond the time allowed by Act.
