CURIOUS WILL CASE.

A- GISBORNE- LEGATEE. (Special to Herald.) AUCKLAND, this day. A cimous featui'e m a will was referred to Mr Justice Hosking yesterday for interpretation. The difficulty was that one person, presumably the same person, ha<l been named twice m one will. The testator called the legatee Ellen m one line of the will, and Nellie a few lines further on m the same will. He bequeathed £100- to Ellen and i 550 to Nellie, both names apparently having reference to tlie one young lady, whose proper name was Helen, Victoria. / Mr T.. N. Stanton appeared for the executor of the will, and Mr J. Stanton for the legatee concerned, Mrs McGuffie. nee Nellie Sceats. The Hon. J. A. Tole, K:C. S appeared for the Public Trustee. Mr Baxter explained that the will was that of the late John Robert Liddle, farmer, late of {iisbonie, and latterly of Auckland, and had been drawn on 6th January. 1913, one month before the death of the testator. In it he had bequeathed £100 to his niece Ellen Sceats, and m the same will i£so to his niece Nellie. The point for the Court- to decide was whether the legatee was to take both legacies. After lengthy legal argument, judgment was reserved.
