A DEBT CASE.
The judgment summons case of C. It. Skeet and Co. (ill* A. W. Rees) v. I<\ S. Spiluian, adjourned from yesterday to enable counsel to go into the point regarding an order being made against a soldier was resumed this afternoon. Nh' Rees further examined debtor as to ' his possession. "About the soldier business,' 1 said Mr Rces. "are you sworn m?" — Witness: No.: — Then you are not a soldier? — What do you mean? ' There is nothing to bind you to go to the camp? — 1 am bound by honor to Well, this is a debt of honor and comes first. Replying further to Mr Rees, debtor said he did not' know -what the financial position of his lato partner was. Witness said he had not been m constant employment. His Worship : What will you get when you are sworn m as a soldier? — I think it is five shillings a day. Now don't you think you should make an offer m regard to this claim? — 1 don't think I can. His Worship said he was inclined to make an order. Mr Rees asked that an order for immediate -payment' of tho whole amount be made. Debtor had no encumbrances and had been earning £3 5h a Areek. Pay under the Defence Department was not attachable. , He did not come under the Army Act, us lie was not sworn m. His Worship said yesterday ho thought debtor was a- Boldiei% but apparently he was «* yet a volunteer. Mr Rees said debtor would . bo-able-to make an allotment off £1 Is a week. His Worship made an order for immediate payment of the amount, £50 4s, m default 50 days' imprisonment, execution to be suspended upon payment of £2 a month, the first payment to be made on the 4th inst. Debtor: In the event of my getting killed will you persist m prosecuting m people? Mr Rees: The discussion when that happens will not interest you. Debtor : No, but it does tiow.
