Mr R. S. Florance, S.M. , has given judgment m. the case of the Cook County Council, (Mr Mayrie) v. T. Broadhead (Mr Arnold). The defendant was charged with removing soil from Russell street without the permission of the pouncil. His; Worship dealt exhaustively with the points raised by counsel as to the question of dedication of the road and the defendant's right' to take soil that had been thrown from a drain alongside a fence. He added that after hearing defendant's evidence and the arguments of counsel he was led irresistibly to the conclusion that the defendant was well aware Russell street was a properly dedicated public road. Defendant was convicted and fined 10s, and costs £1 10s.

The following paragraph appeared m Mr W. T. Mansfield's report to .the Borough Council last night:— "I have disbursed out of petty cash the sum, of 3s 6d for stabling the borough's horse on two stormy nights whilst I was m attendance at meetings. The legality of this payment has heen questioned, but I am at a loss to understand upon what ground. His Worship tho Mayor will doubtless settle this matter with the Finance Committee;, as promised." The Mayor explained that th© auditor had objected to this payment, on the ground that it had not been authorised 6y the Council. Consequently they had nothing else to do but to refuse to pay, ' The Council agreed to sanction the expenditure.

The discharging of tbe cargo brought to Gisborne from London by the s.s. Makarini has been favored with exceptionally fine weather. On last Monday, when work was commenced, there was a fairly heavy roll m the bay, but the unloading was not hampered to any great extent. Yesterday perfect conditions prevailed, and something over 500 tons, of cargo were sent ashore. Into b'no' big lighter * about 280 tons of general cargo were loaded m a little over nine hours, so that good use was made of the time. Three lighters were alongside the vessel to-day, when the holds were haying what is known as "a clear up" of all small packages of Gisborne cargo, and it is expected that the last of the 1350 tons will be put out by 6 o'clock to-night, when the steamer goes on to Napier and Wellington.

An incipient fire was discovered m a linen locker on board the 'Union Company's steamer Rosamond at about 2 a.m. on Sunday, while the vessel was bound from Gisborne and Wliite Island to Auckland. The outbreak was attributed to a loose match being gnawed by a rat, and was extinguished before much damage had been done, a yery small quantity of the ship's linen ben?,-**; charred. Some trouble has been, experienced by the Rosamond's crew m laying down a mooring buoy off White Island. The vessel shipped the buoy some weeks ago, but almost continuous rough weather prevented the work from being carried out, although the steamer was off the island on most of her trips between Auckland and Gisborne. A call was made at the island on Friday la3t,. and, the conditions being favorable, the work of laying the buoy was commenced, but was not completed owing to the shackles of the chain attached to the buoy parting. The mooring buoy is being laid ther© to provide a more secure anchorago for tho various vessels which load sulphur from tho island. X
