_ (Per Press Association.) CHRISTCHURCH, this day. In the case, Mills v. McWilliams, a Supreme Court action, a claim for retention of money under a sub-contract to cart material for Lake Coleridge works, it was contended that the Government took over the works and terminated the sub-contract. The defence was that the Government was merely an agent. Judgment was reserved. In the case Cunningham v t Hepworth, argument was heard on the point whether Hepworth was bound to disclose the full position of the company to Cunningham, who was buying shares. Mr Stringer, for the plaintiff, argued that the company was private m form to evade the requirements of a public compauy to fully disclose. He said that though the shares were issued as the property of individuals, they" were the company's, the money received being used as capital to carry on the company. His Honor said if that view was correct, other members of the Golden Bar Company should be joined. He suggested that he nonsuit the plaintiff and allow a fresh action. He reserved the point for consideration. Sales reported .to-day were: Union Steamship, J&l 4s 6d ; N.Z. Farmers' Co-operative, £2 4s; Waihi, £2 10s 6d. •mammmMmmmmmmmmmtvmmm
