Judge Williams gave judgment m the case, Dalgety and others, appellants, versus the Commissioner of Taxes, an appeal from the decision of the Magistrate, overruling objections to the assessment of income for income tax purposes. The question was Avhat AA'ere the profits derived by appellants from the holding or occupation of Crown lands for the year ending March 31st, 1910, Avhich avos the last year appellants carried on, and during Avhich they held a clearing sale.
