SYDNEY, November 17. The Full Court upheld the demurrer raised by' the plaintiff in the case, Perry (a member of the Assembly) against the Speaker (Mr Willis) and the. Sergeant-at-Arms, for assault and wrongful imprisonment, arising out of > the recent scenes in the Assembly. Defendants pleaded not guilty, .and that any action taken was for the purpose of. preserving order and maintaining the standing orders. . The plaintiff demurred on the second plea, claiming; that, it disclosed no justification' for his being brought back to the- House in custody and detained: The . Court ; held r that the Speaker was-, merely acting as- chairman of a:meeting, arid* had no' positive power. The ; cause - of the disorder having been removed* by the'' plaintiff leaving the Hpusej the Speaker had no power to bring him back, which "Mr J\istice Pring characterised as extraordinary deprivation of a man's liberty.
