In the Appeal Court to-day Mr Cotter, : on behalf of the Auckland Law -Society, moved to have a rule nisi to strike John Raphael +Lnndon/ of. Auckland, off the .roll of barristers and solicitors, for professiqiial, misconduct, ' made absolute. Mr Morrison appeared' for Mr Lundon. Mr Cotter stated that when Haddonwas arrested ' for ]v;wharf'' thefts, Mr' Shelton was iristructeil to act for him, b„t' ; notwithstanding, '■' ''Mr Lundon', ! without communicating with Mr Shelton, obtained an interview with Ha'ddon and ob- j tamed aii order from him to lift the' money iri' the custody of the police. He j obtained £3 18s, 7d. < Next ' morning Haddon' was. asked, m the breserice of bothjmen, who was acting for him, and replied, that. Mr was, but Mr Lundon said nothing] about the money. After that Mr Lundon had a further interview with Haddon, and a letter was Written, partly at his ' dictation, cancelling Mr Shelton's retainer, and appoint- , ing Mr Lundon. Mr St'ieltonwas not to be ''informed of this till after ' he had made application foi- bail, and Mr Lundon was then to take over the case. Mr Slieltpn did make ' application", to Haddon's surprise, Mr Lundon having fold him he had Ifeown tip. the' case. It then came out that Mr Lundon had obtained the money arid Mr. Shelton demanded it from him.'No reply being given a summons was issued. Messrs Sheahan' and Fly nn. acting for Mr Lundon, got the summons withdrawn, and Flyrin paid Ihe money, including costs. Mr .Lundon had not refunded it, because" he objected to costs. Mr Cotter read affidavits m support of his case.
