In the ' Appeal Court case, Mewhinney v. Mewhinney, Mr Justice Denniston delivered th'e judgment of the Court, varying the order made by Sir Robert Stout, and giving legal custody to thi* appellant, but making a condition that until a further order of the Supreme Court the boy should be placed as a boarder m the Catholic school for boys at Seatoun, and the girl as a boarder m the convent at Wellington, with access to children to both the appellant father and respondent mother, as the governing authorities of the schools think it consistent with the discipline of the schools and interests of the children. No costs were allowed. h\ the Samson v. Archison appeal against a judgment for damages for negligent driving of a motor car, the Appeal Court dismissed the appeal, on the ground that the owner, who was m the car but not driving, was m control. Costs on the highest scale were allowed. Leave to appeal to the Privy Council wa« granted. In the Appeal Court, m the case, Rex v. Reynolds and Peterson, the Court was unanimously of opinion that there should be a new trial, there being a substantial miscarriage of justice, as the Crown were entitled to have tho jury's verdifct on the evidence adduced m Court. Sir Robert Stout, m dissenting, said he considered the prisoners should have a separate trial, which had been- refused m the lower court. A new trial was ordered, leaving it to the pri soners, if they wish it, to apply for a separate trial.
